THE WHAT? The US Supreme Court has refused an appeal in the now infamous 2018 St Louis talc litigation, leaving Johnson & Johnson with US$2.1 million to pay in damages, according to a report published by Bloomberg.

THE DETAILS Johnson & Johnson set aside some US$4 billion in preparation for payment of the damages back in February. The original award was US$25 million to each of the 20 plaintiffs plus US$4 billion in punitive damages – although a state appeals court cut this considerably last year.

THE WHY? The Supreme Court declined to give a reason for its decision and, as a spokesperson for Johnson & Johnson was keen to point out to Bloomberg, ‘its decision to deny hearing a case expresses no view on its merits’.
